Terms of Use
1. Agreement to these terms
These Terms of Use govern your use of nextplaypro.ai (the “Site”), operated by NEXTPlay Holdings, LLC, a Delaware limited liability company (“NEXTPlay,” “we,” “us”), which operates the NEXTPlay franchise and its divisions and teams. By using the Site or signing up for updates, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the Site.
2. Who can use the Site
You must be 18 or older to sign up for updates. If you are under 18, a parent or guardian may sign up on your behalf and should review these terms with you.
3. Using the Site
You may use the Site for your personal, non-commercial use. You agree not to:
- copy, scrape or harvest content or data from the Site by automated means;
- interfere with the Site’s security or operation, or try to access areas you are not authorized to use;
- use the Site to send spam or unlawful, harassing or misleading content;
- sign up using someone else’s information without their permission.
4. Our content and trademarks
All content on the Site, including text, images, logos, graphics, team identities and design, belongs to NEXTPlay or its licensors and is protected by intellectual property laws. NEXTPlay, NEXTPlay PRO, NEXTPlay FLAG, NEXTPlay FUTURES, Atlanta Heat, Chicago Sentinel, Colorado 14ers, Dallas Apex, Los Angeles Crown, Seattle Tempest and their logos are trademarks of NEXTPlay Holdings, LLC. You may not use them without our written permission. Arena names and marks belong to their respective owners.
Athlete imagery on the Site is illustrative and does not depict contracted NEXTPlay athletes unless stated otherwise.
5. Forward-looking information
Information about launch dates, team markets, venues, divisions, game format, broadcast features, schedules and future expansion reflects our current plans. These plans may change, and nothing on the Site is a promise that any event, feature, venue or product will be offered.
6. Predictions, fantasy and promotions
Any prediction, fantasy, contest or sweepstakes feature will be governed by its own official rules, will be offered only where permitted by law, and may be subject to age and location restrictions.
7. Links to other sites
The Site links to social media and other third-party sites. We are not responsible for their content or practices, and their own terms and privacy policies apply.
8. Disclaimers
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, NEXTPlay disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Site will be uninterrupted or error-free.
9. Limitation of liability
To the fullest extent permitted by law, NEXTPlay will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars (US$100).
10. Indemnity
You agree to indemnify NEXTPlay against claims arising from your misuse of the Site or your breach of these terms.
11. Governing law
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in the State of Delaware, and you consent to the jurisdiction of those courts, unless applicable law requires otherwise.
12. Changes to these terms
We may update these terms from time to time. We will post the updated terms here with a new effective date. Continued use of the Site after changes take effect means you accept them.
13. Language
These terms are also available in Spanish and German for convenience. If a translation differs from the English version, the English version controls.
